PITTSBURGH (Newsradio 1020 KDKA) - Sixteen states have filed suit against President Trump’s emergency declaration that would divert money from defense and other departments to build a border wall at the Southern border.

Pennsylvania is not one of them but state Attorney General Josh Shapiro said in a statement Monday that there is a lot of Pennsylvania money at risk with the emergency funding:

“I am deeply concerned about the legality of President Trump’s national emergency declaration and its impact on Pennsylvania. Congress has allocated tens of millions of dollars to our Commonwealth that could be diverted for this fictional emergency—but the federal government has not yet provided clear guidance on their funding sources. As we learn more, I will continue to work with the Wolf Administration and our Congressional delegation to prevent harm to Pennsylvania.”

Governor Tom Wolf told KDKA Radio Tuesday while it is not known for sure where the money will come from at this point, he says it looks like it will come from a drug and addiction fund.

“This has gone to the National Guard and is really focused on the criminal justice side of the opioid epidemic on drug trafficking and that is where we think the money is coming from but it’s not clear at this point, they haven’t really made their final decision,” said Wolf.

Wolf added they will not join the lawsuit until it is known for sure what funds will be affected.

“Until we know for sure, the Attorney General cannot in good conscience say we are realistically going to be harmed, here’s how and so we have to be part of this lawsuit.”

If the state can point to the specific funds that would be diverted, Wolf says Pennsylvania will join the lawsuit that was originally filed in California.
